Article 1: General Provisions

The purpose of these General Terms of Use (hereinafter «GTU») is to define the terms and conditions for accessing, browsing, and using the website mumspapillescare.be (hereinafter «the Site»).

Any natural person or legal entity who accesses the Site, browses it, registers on it, or interacts in any way with its content or features is considered a «User».

Access to and use of the Site imply full, complete, and unreserved acceptance of these Terms of Use by the User. This acceptance occurs as soon as the User browses the Site. If the User does not accept these Terms of Use, they are requested not to use the Site and to leave it immediately.

These Terms of Use apply without prejudice to the General Terms and Conditions of Sale (GTCS) of Mum’s Papilles & Care, which specifically govern any order for products or services placed via the Site. In the event of a contradiction, the GTCS shall prevail with regard to everything concerning the contractual sales relationship.

The Site is published by Mum’s Papilles & Care SRL, with its registered office located at Clos de l’Aronelle 19, 1474 Ways (Genappe), Belgium, registered with the Crossroads Bank for Enterprises under number 1040.338.361 and identified for VAT under number BE 1040.338.361.

Article 2: Modification

Mum’s Papilles & Care reserves the right to modify, adapt or supplement these Terms of Use at any time, in particular to bring them into compliance with any legal, regulatory, jurisprudential or technical development, or in the event of changes to its activities, services or Site features.

The applicable Terms of Use are those in effect at the time the user consults the Site. It is the user's responsibility to regularly check the Terms of Use to stay informed of any changes.


Article 3: Service Descriptions

Mum’s Papilles & Care offers a service for preparing and delivering healthy, balanced, and delicious home-cooked meals, made from seasonal ingredients and, whenever possible, sourced locally.

The meals are designed with a well-being and comfort-eating approach, in collaboration with a dietitian, to offer consistent menus adapted to different moments and situations in life, without replacing medical advice or monitoring.

The services are aimed in particular at people wishing to benefit from practical, high-quality meals, as well as their loved ones or caregivers, in a non-therapeutic setting.

Products can be ordered individually or as subscriptions via the website mumspapillescare.be, in accordance with the terms specified in the General Terms and Conditions of Sale (GTCS). Deliveries are made in Belgium, mainly in the Walloon Brabant region, according to the areas and time slots indicated when ordering. Partner pickup points may also be offered.

Mum’s Papilles & Care reserves the right to modify its product offerings, services, subscription plans, delivery areas, and practical procedures at any time, in accordance with the development of its business operations.

The content published on the Site is for informational and descriptive purposes only and does not in any way constitute medical, personalized dietary, or therapeutic advice.


Article 4: Intellectual Property

All elements making up the Site, in particular texts, editorial content, recipes, visuals, photographs, illustrations, logos, graphic identity, domain names, databases, as well as any other element present on the Site, are protected by intellectual property rights and remain the exclusive property of Mum’s Papilles & Care, unless stated otherwise.

Any reproduction, representation, adaptation, modification, translation, distribution, or exploitation, whether total or partial, of all or part of the Site or its content, by any process whatsoever and on any medium whatsoever, is strictly prohibited without the prior written authorization of Mum’s Papilles & Care.

The use of the Site and its content is authorized solely for personal, private, and non-commercial use. Any unauthorized use may give rise to civil and/or criminal prosecution in accordance with applicable legislation.


Article 5: Content

Mum's Papilles & Care makes every effort to ensure, as far as possible, the accuracy, timeliness, and clarity of the information published on the Site. However, the content disseminated is for informational and descriptive purposes only and may be modified at any time without notice.

Mum’s Papilles & Care is bound by an obligation of means regarding the content of the Site and cannot guarantee the complete absence of errors, omissions, or inaccuracies. The user is invited to report any anomaly or inconsistency via the contact details mentioned on the Site.

The visuals, photographs, product descriptions, and menus presented on the Site are for illustrative purposes only and are non-contractual. Slight differences may exist, notably due to the seasonality of ingredients, supply constraints, or recipe developments, without incurring the liability of Mum’s Papilles & Care.

Mum’s Papilles & Care reserves the right to suspend, modify, or interrupt, temporarily or permanently, all or part of the content of the Site, particularly for technical reasons, maintenance, or the development of its business.


Article 6: Site management

Mum’s Papilles & Care makes every effort to ensure the accessibility and proper functioning of the Site. However, it cannot guarantee permanent availability and reserves the right to suspend, limit or interrupt access to the Site, in whole or in part, particularly for maintenance, updating, security or technical reasons, without its liability being incurred in this respect.

Mum's Papilles & Care reserves the right to delete, without notice, any content, user account, comment, or behavior that it deems contrary to these General Terms of Use, the General Terms and Sale, applicable legislation, or public morals.

The user agrees to use the Site in a fair and lawful manner. In particular, they are prohibited from:

  • to use the Site for illegal or fraudulent purposes; ;
  • to impair the proper operation, security, or integrity of the Site; ;
  • to introduce or distribute viruses, malware, or any other device capable of damaging the Site; ;
  • to usurp the identity of a third party or to infringe upon the rights of third parties, particularly regarding privacy or intellectual property; ;
  • to use the Site for unauthorized advertising or promotional purposes.

Mum’s Papilles & Care declines all liability in the event of direct or indirect damage resulting from improper use of the Site by the user.

Mum’s Papilles & Care reserves the right to moderate, delete, or refuse any content, interaction, or behavior that undermines respect for individuals, its values, its image, or the proper functioning of the Site, without incurring any liability in this regard.


Article 7: User account

Access to certain features of the Site may require the creation of a personal user account. When creating this account, the user agrees to provide accurate, complete, and up-to-date information. The information marked as mandatory is necessary for account management and, where applicable, the fulfillment of orders.

The user account is strictly personal. The user is solely responsible for the confidentiality of their login credentials and any use made via their account. They undertake not to share them with third parties and to immediately inform Mum’s Papilles & Care of any unauthorized use of their account.

The user agrees not to create an account on behalf of a third party, not to impersonate someone else, and not to use another user's account.

Mum’s Papilles & Care reserves the right to suspend or delete a user account, without compensation, in the event of failure to comply with these T&Cs, the GTCS, the provision of inaccurate information, fraudulent use of the Site, or behavior contrary to applicable legislation.

The deletion of a user account does not automatically entail the cancellation of previously incurred contractual obligations, particularly in the event of pending orders or unresolved disputes.


Article 8 : Newsletter

The user can voluntarily subscribe to the Mum’s Papilles & Care newsletter by providing their email address via the forms provided for this purpose on the Site.

Newsletter subscription implies the user's explicit consent to receive electronic communications containing information, news, offers, or content related to the activities of Mum’s Papilles & Care.

The user can unsubscribe at any time, free of charge and without giving a reason, by clicking on the unsubscribe link in each newsletter or by sending a request using the contact details mentioned on the Site.

The personal data collected as part of the newsletter subscription is processed in accordance with applicable data protection regulations and the Mum's Papilles & Care privacy policy.


Article 9: Use of cookies

A cookie is a small text file that may be saved on the user's device (computer, tablet, smartphone) when visiting the Site. In particular, it makes it possible to recognize the user's device and facilitate navigation.

The Site uses different types of cookies:

  • Strictly necessary cookies: essential for the proper functioning of the Site (security, navigation, access to essential features). These cookies cannot be disabled.
  • Audience measurement and performance cookies: allow the collection of anonymous statistical data in order to analyze traffic to the Site and improve its operation.

The user is invited to consult the terms of use and privacy policies specific to each third-party site they visit via a hyperlink on the Site.


Article 11: Protection of Private Personal Data

The use of the Site by users may result in the communication of personal data. Mum’s Papilles & Care acts as the data controller and processes this data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Belgian legislation.

11.1 Data collected and collection methods

Personal data may be collected and processed in particular via:

  • the contact and order forms available on the Site; ;
  • the creation and management of a user account, where applicable; ;
  • telephone or email communications with Mum's Papilles & Care; ;
  • payment tracking via a secure payment service provider; ;
  • the use of the Site and browsing (cookies – see Article 9).

11.2 Purposes of processing

The collected data is processed for the following purposes:

  • manage, process, and fulfill orders; ;
  • organize meal delivery ;
  • ensure invoicing and compliance with legal and tax obligations; ;
  • manage customer relations (after-sales service, complaints, follow-up) ;
  • improve the functionality of the Site and the user experience; ;
  • send information or commercial offers, only if the user has explicitly consented (e.g. newsletter subscription).

The user is informed that the absence or inaccuracy of certain data may prevent the smooth processing of orders or services. Mum’s Papilles & Care cannot be held responsible for the consequences related to the communication of erroneous or incomplete data.

11.3 Nature of processed data

Data likely to be processed includes, in particular:

  • identification data: last name, first name; ;
  • contact information: postal address, email address, phone number; ;
  • order data: chosen products, any preferences, order date and time; ;
  • payment data: information necessary for the transaction (banking data is never stored by Mum’s Papilles & Care, but only by the secure payment service provider); ;
  • delivery data: address and specific instructions; ;
  • browsing data: IP address, cookies and consultation data, with prior consent where applicable.

11.4 Shelf life

Personal data is kept for a maximum period of two years from the last interaction with the user, barring legal obligations requiring a longer retention period (particularly in accounting matters). At the end of these periods, the data is deleted or archived in accordance with applicable regulations.

11.5 User Rights

In accordance with the GDPR, the user has the right to access, rectify, erase, restrict processing, object to, and port their personal data.

The user may withdraw their consent at any time, without affecting the lawfulness of the processing carried out previously.

11.6 Data Security

Mum’s Papilles & Care is committed to implementing reasonable technical and organizational measures to ensure the security and confidentiality of personal data. This obligation constitutes a best-efforts obligation.

Article 12: Severability Clause

If any provision of these General Terms of Use is declared null, invalid, unenforceable, or illegal, in whole or in part, pursuant to a statutory or regulatory provision or following a final court decision, such provision shall be deemed unwritten, without affecting the validity, legality, or enforceability of the other provisions.

The parties undertake, to the extent possible, to replace the invalidated provision with a valid provision having an economic and legal effect as close as possible to that of the initial provision.


Article 13: Jurisdiction and Applicable Law

These Terms of Use are governed by Belgian law.

In the event of a dispute relating to the interpretation, execution, or validity of these General Terms of Use, and failing an amicable resolution, the courts of the judicial district of the registered office of Mum’s Papilles & Care shall have sole jurisdiction, barring any mandatory or public policy provisions to the contrary.

The parties acknowledge and accept, in the context of their relationship, the evidentiary value of electronic means of proof, including emails, computer data, connection logs, and digital recordings.

For any order placed via the Site, the General Terms and Conditions of Sale (GTCS) of Mum’s Papilles & Care apply in addition to these General Terms of Use and prevail in the event of any contradiction regarding all matters relating to the sales contract relationship.
